End-of-Life Products

We may introduce new products and discontinue older ones based on customer demand. If a new product becomes available, you can upgrade via the client portal. If we discontinue a product, we'll provide 60 days' notice and work with you to find a solution that meets your needs.

Chargebacks and Disputes

We're committed to providing the best possible experience. If our products don't meet your needs, please review our Refund and Cancellation policies. If a billing dispute, claim, or chargeback occurs, you authorize us to share your account information (including your name, address, IP address, account history, and any files stored on our system) with our payment processors. In cases of fraudulent chargebacks or disputes, we may also share this information with third-party fraud prevention platforms like MaxMind and FraudRecord, as well as law enforcement.

Cryptocurrency Payment Policy

Due to the volatility and transaction fees associated with cryptocurrency, any product refunds, cancellations, or modifications for cryptocurrency-based transactions will be applied as account credit only; we cannot issue cash refunds.

Promotions

CycloneServers, LLC may periodically offer promotional discounts or special pricing on products and services. These promotions are subject to expiration at our discretion, which could be after a specified duration, a set number of redemptions, or due to changes in market conditions. Please note that some promotions may not apply to plan upgrades or when transitioning to updated plans while using a promotional code.

Price Match

We'll price match verifiable and valid competitor pricing displayed on their website or in advertising, within reasonable standards.

Price Adjustments

To remain competitive, we may adjust our plans and pricing. To update your plan to current offerings, please contact our billing team. While we can't modify already paid invoices, we're happy to update your plan for future invoices.

Country Block Policy

If a CycloneServers product is blocked by a business, institution, or country firewall, we may attempt to move you to an unblocked node, but you'll need to submit a support ticket. Product availability and pricing may vary between data centers. Cancellation requests outside of our refund period are subject to our standard cancellation policy.

Legal Contact

CycloneServers, LLC reserves the right to involve appropriate authorities in the event of any Terms of Service (ToS) violation or illegal activity. All communication is confidential. Unauthorized sharing of communication may result in legal action.

By using a server with CycloneServers, you authorize us to modify your server as necessary, including any tasks related to running a Virtual Private Server (VPS). Any threats against our servers or equipment will be taken seriously and may result in investigation and possible legal action.

If payments are canceled, your server will be suspended unless prior arrangements are made. While we keep files as long as possible post-termination or suspension, we don't guarantee a specific timeframe. CycloneServers, LLC has the sole right to control, start, stop, and modify your server.

Rent-to-Own (RTO) Policy

Rent-to-Own Servers remain the sole property of CycloneServers, LLC until the RTO terms are met. These terms are: uninterrupted RTO service for 12 consecutive months and no abuse tickets filed against you. Any abuse complaint, ToS violation, or suspension immediately disqualifies you from RTO terms and converts the service to a rented status.

If you don't meet RTO terms, you're responsible for contacting support for server transfer to colocation (at a price determined by our sales team) or to cancel service and request shipment (at your expense). Failure to comply with RTO Terms forfeits any payments made towards the service.

Colocation Contractual Agreement

Colocation plans ordered after November 2023 are subject to a 12-month contract term. Canceling before the term ends will require immediate payment of the remaining balance. Only CycloneServers, LLC Management may waive the contract terms, unless required by law.

Unmetered Policy

Unmetered products and add-ons use the 95th percentile rate. We monitor all services, as bandwidth resources are finite.

Bandwidth Overage Policy & IP Blacklist Policy

Bandwidth overages will be charged at $5 per TB. Contact our support for additional bandwidth purchases at a lower rate than the overage fee.

Blacklisted IPs incur a $15 fee per IP. If an entire IP subnet is blacklisted, you're responsible and will be charged $150 per IP subnet. If an ASN-level ban occurs, the responsible client will be charged $1500, plus the costs to clear the IPs.

Termination

CycloneServers, LLC reserves the right to terminate any service for Terms of Service (ToS) violations or any other reason we deem necessary.

Threats/Staff Abuse

Using CycloneServers, LLC services to transmit any material that threatens harm or property damage will result in immediate termination. Using our services for harassment will also result in immediate termination. Hateful, rude, or threatening messages to staff may result in termination, at CycloneServers, LLC staff's discretion.

Forgery, Impersonation, and Invalid Information

Modifying network header information to deceive is prohibited. Impersonating others by using forged headers or information is also prohibited. Anonymous remailers and nicknames do not constitute impersonation. Any invalid information must be updated, or your account risks suspension and termination without refund.

Unauthorized Access

Any activity affecting others' ability to use CycloneServers, LLC’s services, including Denial of Service attacks or any network disruptions, is prohibited. It's your responsibility to ensure a secure network configuration and not allow your network to be used for illegal actions. Unauthorized entry into another computer system will result in termination. CycloneServers, LLC will not tolerate any attempt to access another's account or penetrate security measures, regardless of data corruption or loss.

Fraud

Any fraudulent activity, misrepresentation, or misleading statements with the intent to deceive will be investigated. Our products may link to third-party sites, services, and offers that we don't control and aren't responsible for. Accessing any third-party site is at your own risk. Failure to submit a cancellation request will result in your information being submitted to FraudRecord and MaxMind.

Backups and Data

CycloneServers, LLC is not responsible for any data loss. You are responsible for backing up all data on Virtual Private Servers, Hybrid Servers, and Dedicated Servers. Backups can be provided per request.

Service Suspension

CycloneServers, LLC may disable or terminate any product immediately. Unpaid accounts will result in the removal of all customer data from servers upon termination. CycloneServers, LLC is not liable for lost data due to customer negligence.

Banned Services

All CycloneServers, LLC services must be used for lawful and moral purposes. You agree to indemnify CycloneServers, LLC from any claims resulting from your use of our services. The following services or activities are strictly prohibited:

• Creating/Maintaining Multiple Accounts on https://clients.cycloneservers.net

• Intentionally Bypassing Promotional Code/Offer rules

• IRC Servers

• Cracked Copies of Software / Licenses

• Traffic Exchange, HitLeap, Crawlers, iMarcos, AutoSurf, etc.

• Pirated Content / Warez / Topsites / Illegal Content

• Email Spam/Sending of any type that causes blacklisting

• Investment Sites (HYIP, FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)

• Lottery / Gambling Sites / Bank Debentures / Bank Debenture Trading Programs

• Fraudulent / Phishing / Replica Sites

• Virtual Currency Mining

• DDoS-prone applications or booters/flood scripts / IP spoofing software

• IP Scanners / Port Scanning or Bruteforce Programs

• QEMU / Nested virtualization and related (on VPS/VDS products only)

• Cracking tools / illegal software key generators

• Programs that cause hardware resource/network abuse in excess of your specified plan

• Growtopia-related services (private servers, tools, bots, or websites) — no refunds if banned

Any violation of these terms may result in service suspension without refund. This list isn't exhaustive and serves as an indication of disallowed uses. Any abuse reported and verified will result in a $15 account fine.

Indemnification

You agree to defend, indemnify, and hold harmless CycloneServers, LLC, its officers, directors, employees, and agents from any claims, actions, or demands, including reasonable legal and accounting fees, arising from your use of the Services or your breach of this agreement.

Limitation of Liability

CycloneServers, LLC is not liable for any claimed damages, including incidental and consequential damages, resulting from server unavailability for any reason. Furthermore, CycloneServers, LLC is not responsible for damages from the corruption or deletion of any website on our servers. All damages will be limited to the immediate termination of service.

Disclaimer of Warranties

The Services are provided on an "as-is" and "as-available" basis. CycloneServers, LLC makes no warranty, express or implied, including any warranty for merchantability or fitness for a particular purpose. CycloneServers, LLC does not guarantee uninterrupted, error-free, or completely secure services.

Governing Law

This agreement is governed by the laws of the State of VA.

Collections

Any unpaid balance that's overdue due to ToS violations will not be canceled. You authorize CycloneServers, LLC to send unpaid invoices to collections and attempt payment using account payment methods. Any chargebacks on collection invoices will result in fines up to $50 per chargeback.

Entire Agreement

This agreement represents the entire agreement between the parties and supersedes all prior agreements regarding the subject matter. This agreement may not be amended unless in writing and signed by authorized representatives from both parties.
