Terms of Service

CycloneServers, LLC (“CycloneServers,” “Us,” “We”) provides services to you (“Subscriber,” “Customer,” “Client,” “You”) under the following Terms of Service. By using our services, you agree to this ToS and our Acceptable Use Policy (“AUP”). CycloneServers may update this ToS at any time. Updates do not allow early termination or non-payment. All customers must provide valid, verifiable information at sign-up.

Promotions, Pricing & Plan Eligibility

Promotions

• Promotions, discount codes, flash sales, and special offers cannot be applied to existing or currently-active services.

• Promotions apply only to new orders placed after the promotion begins.

• Promotions cannot be retroactively applied to past invoices.

Price Changes

• New pricing or new plan structures do not apply to existing services.

• Existing services keep their original pricing permanently unless the customer orders a new plan.

Plan Upgrades / Downgrades

• Legacy plans cannot be upgraded or downgraded to new plans or new pricing.

• Clients who want a new plan must order it as a separate service.

• Existing services cannot be modified to adopt newer pricing models.

Spam & Abuse Complaints

If CycloneServers receives an abuse complaint for spam originating from your service:

• You will receive one (1) warning.

• If spam continues, the service will be terminated without refund.

Spam includes: email spam, unsolicited mass messaging, blacklisting activity, automated spam systems, or complaints from upstream providers.

Refund Policy

Refunds may be issued within 72 hours of your first purchase of new, unused services if we cannot resolve your issue.

Refund Conditions:

• Refunds apply only to the first invoice of new clients.

• Not eligible: promotions, discounts, addons, custom services, pre-orders.

• PayPal recurring payments must be cancelled manually. Overpayments remain as credit.

• A 20% processing fee applies to PayPal/Stripe refunds.

• Violations of the ToS void refund eligibility.

Affiliate Program

Affiliate payouts are provided as account credit only. No cash payouts.

Cancellations

Cancellations must be submitted via:

• Client Portal

• Discord

• Ticket System

Requests must be submitted 72 hours before the due date to avoid charges.

Failure to cancel properly may result in:

• Late fees

• Collections

• Account bans

• Permanent denial of service for repeated failures

End-of-Life (EOL) Products

Products may be discontinued or replaced. If discontinued, CycloneServers will provide 60 days’ notice. Upgrades may be available depending on product type.

Chargebacks & Disputes

In the event of a chargeback or dispute:

• CycloneServers may share your information with payment processors, MaxMind, FraudRecord, and law enforcement (if fraud is suspected).

• Fraudulent disputes may result in account termination.

Cryptocurrency Payments

Crypto payments are non-refundable in cash. Any adjustments or credits are issued as account credit only.

Promotions Policy

CycloneServers may offer promotions at any time. Promotions:

• Do not apply to existing services

• May expire based on time or redemption limits

• Cannot typically be combined

Price Match

We match verified competitor pricing within reasonable limits.

Country Block Policy

If your service is blocked by a business or country firewall, we may attempt to relocate you. Standard cancellation policies still apply.

Legal Contact

CycloneServers may involve authorities for ToS violations or illegal activity. Communication with staff is confidential and may not be shared without authorization.

Threats or harassment toward staff or infrastructure may result in immediate termination.

Rent-to-Own (RTO) Policy

RTO servers remain CycloneServers’ property until:

• 12 consecutive months of payments are completed

• No abuse or ToS violations occur

If RTO eligibility is voided:

• The server becomes a standard rental

• You must move to colocation (fees apply) or request shipment (at your expense)

• Failure results in forfeiture of all payments made

Colocation Agreement

Colocation plans ordered after November 2023 include a 12-month contract. Early cancellation requires payment of the remaining term.

Unmetered Policy

Unmetered services use 95th percentile bandwidth measurement.

Bandwidth Overage & Blacklist Fees

• Bandwidth overages: $5 per TB

• Blacklisted IP fee: $15 per IP

• Blacklisted subnet fee: $150 per subnet

• ASN-level ban fee: $1500, plus cleanup costs

Termination

CycloneServers may terminate services for ToS violations or any reason we deem necessary.

Threats / Staff Abuse

Threats, harassment, abusive language, or hostile behavior toward staff may result in immediate suspension or termination.

Forgery, Impersonation & Invalid Information

Prohibited actions include:

• Forged headers

• Impersonation

• Providing false or incomplete information

• Failing to maintain accurate account details

Violations may result in suspension or termination.

Unauthorized Access

Strictly prohibited:

• Unauthorized access attempts

• Security bypass attempts

• DoS/DDoS attacks

• Interference with network operations

• Penetration testing or scanning without explicit approval

Fraud

Fraud or misrepresentation may result in investigation and reporting to FraudRecord and MaxMind. Failure to properly cancel services may also trigger reporting.

Backups & Data Responsibility

Clients are responsible for their own data backups. CycloneServers is not liable for data loss of any kind.

Service Suspension

Unpaid invoices may result in service suspension and permanent data deletion after termination.

Banned Services

The following are strictly prohibited:

• Multiple client accounts

• Promo code abuse

• IRC services

• Pirated content / warez

• Traffic exchange / autosurf

• Email spam

• Investment / HYIP / Ponzi / MLM

• Gambling / bank debentures

• Fraud / phishing

• Cryptocurrency mining

• DDoS tools / booters / IP spoofing

• Scanners / bruteforce tools

• Nested virtualization (VPS)

• Cracking/keygen tools

• Excessive resource abuse

• Growtopia-related services

Violations may incur a $15 fine and immediate suspension.

Indemnification

You agree to indemnify and hold harmless CycloneServers, its staff, and its owners from claims arising from your use of our services.

Limitation of Liability

CycloneServers is not liable for:

• Downtime

• Data loss

• Corruption

• Incidental or consequential damages

Liability is limited to the termination of service.

Disclaimer of Warranties

Services are provided as-is and as-available, without any guarantee of performance, uptime, or security.

Governing Law

This agreement is governed by the laws of Virginia (VA).

Collections

Unpaid balances may be sent to collections. Chargebacks at this stage may incur a $50 fee.

Entire Agreement

This document is the complete agreement between you and CycloneServers. Amendments must be in writing and signed by authorized representatives.
